In general, you can use the Mein Wortschatz website without providing any personal data. However, if a data subject wishes to use specific services offered by our company via our website, the processing of personal data may be necessary. If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the consent of the data subject.

The processing of personal data—such as a data subject’s name, address, email address, or phone number—is always carried out in accordance with the General Data Protection Regulation and in compliance with the country-specific data protection regulations applicable to Mein Wortschatz. Through this Privacy Policy, our company aims to inform the public about the nature, scope, and purpose of the personal data we collect, use, and process. Furthermore, this Privacy Policy informs data subjects of their rights.

As the data controller, Mein Wortschatz has implemented numerous technical and organizational measures to ensure the most comprehensive protection possible for the personal data processed through this website. However, internet-based data transmissions may generally involve security vulnerabilities, meaning that absolute protection cannot be guaranteed. For this reason, any data subject is free to provide personal data to us through alternative means, such as by telephone.

3. Cookies

The Mein Wortschatz website uses cookies. Cookies are text files that are placed and stored on a computer system via a web browser.

Numerous websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier for the cookie. It consists of a string of characters through which websites and servers can be assigned to the specific internet browser in which the cookie was stored. This enables the websites and servers visited to distinguish the individual browser of the data subject from other Internet browsers that contain other cookies. A specific Internet browser can be recognized and identified via the unique cookie ID.

Through the use of cookies, Mein Wortschatz can provide the users of this website with more user-friendly services that would not be possible without the cookie setting.

By means of a cookie, the information and offers on our website can be optimized for the benefit of the user. As already mentioned, cookies enable us to recognize the users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, the user of a website that uses cookies does not have to re-enter their access data each time they visit the website because this is taken over by the website and the cookie stored on the user’s computer system. Another example is the cookie for a shopping basket in an online store. The online store remembers the items that a customer has placed in the virtual shopping cart via a cookie.

The data subject can prevent the setting of cookies by our website at any time by means of a corresponding setting of the Internet browser used and thus permanently object to the setting of cookies. Furthermore, cookies that have already been set can be deleted at any time via an Internet browser or other software programs. This is possible in all common Internet browsers. If the data subject deactivates the setting of cookies in the Internet browser used, not all functions of our website may be fully usable.

4. Collection of general data and information

The Mein Wortschatz website collects a range of general data and information each time a data subject or an automated system accesses the website. This general data and information is stored in the server’s log files. The following may be collected: (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (known as the referrer), (4) the subpages on our website accessed via the accessing system, (5) the date and time of access to the website, (6) an Internet Protocol (IP) address, (7) the Internet service provider of the accessing system, and (8) other similar data and information used for security purposes in the event of attacks on our information technology systems.

When using this general data and information, Mein Wortschatz does not draw any conclusions about the data subject. Rather, this information is needed to (1) correctly deliver the content of our website, (2) to optimize the content of our website and the advertising on it, (3) to ensure the ongoing functionality of our information technology systems and the technology of our website, and (4) to provide law enforcement authorities with the information necessary for criminal prosecution in the event of a cyberattack. This anonymously collected data and information is therefore evaluated by Mein Wortschatz both for statistical purposes and with the aim of enhancing data protection and data security within our company, ultimately to ensure an optimal level of protection for the personal data we process. The anonymous data from the server log files is stored separately from any personal data provided by a data subject.

5. Registration on our website

The data subject has the option of registering on the controller’s website by providing personal data. Which personal data is transmitted to the controller is determined by the respective input mask used for registration. The personal data entered by the data subject is collected and stored exclusively for internal use by the controller and for the controller’s own purposes. The controller may arrange for the data to be passed on to one or more processors, such as a parcel service provider, who will also use the personal data exclusively for internal use attributable to the controller.

By registering on the controller’s website, the IP address assigned by the data subject’s Internet service provider (ISP), the date and time of registration are also stored. This data is stored against the background that this is the only way to prevent the misuse of our services and, if necessary, to make it possible to investigate criminal offenses committed. In this respect, the storage of this data is necessary to safeguard the controller. This data is not passed on to third parties unless there is a legal obligation to pass it on or it serves the purpose of criminal prosecution.

The registration of the data subject with voluntary provision of personal data serves the controller to offer the data subject content or services which, due to the nature of the matter, can only be offered to registered users. Registered persons are free to change the personal data provided during registration at any time or to have it completely deleted from the controller’s database.

The controller shall provide any data subject at any time upon request with information about what personal data is stored about the data subject. Furthermore, the controller shall rectify or erase personal data at the request or indication of the data subject, insofar as this does not conflict with any statutory retention obligations. All of the controller’s employees are available to the data subject as contact persons in this context.

6. Contact possibility via the website

In accordance with legal requirements, the Mein Wortschatz website contains information that enables users to quickly contact our company electronically and communicate directly with us, including a general electronic mail (email) address. If a data subject contacts the data controller via email or through a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data, provided voluntarily by a data subject to the data controller, is stored for the purpose of processing the request or contacting the data subject. This personal data is not disclosed to third parties.

7. Comment function in the blog on the website

Mein Wortschatz offers users the opportunity to leave individual comments on specific blog posts on a blog located on the data controller’s website. A blog is a portal hosted on a website—typically accessible to the public—where one or more people, known as bloggers or web bloggers, can post articles or share their thoughts in so-called blog posts. Third parties can generally comment on these blog posts.

If a data subject leaves a comment in the blog published on this website, information about the time of the comment entry and the user name (pseudonym) chosen by the data subject are stored and published in addition to the comments left by the data subject. Furthermore, the IP address assigned by the data subject’s Internet service provider (ISP) is also logged. The IP address is stored for security reasons and in the event that the data subject violates the rights of third parties or posts illegal content by posting a comment. This personal data is therefore stored in the controller’s own interest so that the controller can exculpate itself in the event of an infringement. The personal data collected will not be passed on to third parties unless such a transfer is required by law or serves the legal defense of the controller.

8 Routine deletion and blocking of personal data

The controller shall process and store the personal data of the data subject only for the period necessary to achieve the purpose of storage, or as far as this is granted by the European legislator or other legislators in laws or regulations to which the controller is subject to.

10 WooCommerce

We have integrated the WooCommerce open source store system as a plugin on our website. This WooCommerce plugin is based on the WordPress content management system, which is a subsidiary of Automattic Inc (60 29th Street #343, San Francisco, CA 94110, USA). The implemented functions send, store and process data to Automattic Inc. In this privacy policy, we inform you what data is involved, how the network uses this data and how you can manage or prevent data storage.

What is WooCommerce?

WooCommerce is an online store system that has been part of the WordPress directory since 2011 and was developed specifically for WordPress websites. It is a customizable, open-source eCommerce platform that is based on WordPress and has also been integrated into our website as a WordPress plugin.

Why do we use WooCommerce on our website?

We use this practical online store solution to offer you our physical or digital products or services on our website in the best possible way. The aim is to provide you with simple and easy access to our range so that you can find the products you want quickly and easily. With WooCommerce, we have found a good plugin that meets our requirements for an online store.

What data is stored by WooCommerce?

Information that you actively enter in a text field in our online store can be collected and stored by WooCommerce or Automattic. So when you register with us or order a product, Automattic can collect, process and store this data. In addition to your e-mail address, name or address, this may also include credit card or billing information. Automattic may subsequently use this information for its own marketing campaigns.

In addition, there is also information that Automattic automatically collects from you in so-called server log files:

  • IP address
  • Browser information
  • Preset language setting
  • Date and time of web access

WooCommerce also sets cookies in your browser and uses technologies such as pixel tags (web beacons), for example to clearly identify you as a user and possibly offer interest-based advertising. WooCommerce uses a number of different cookies that are set depending on the user action. This means, for example, that when you place a product in the shopping cart, a cookie is set so that the product remains in the shopping cart when you leave our website and return at a later time.

Here we show you an exemplary list of possible cookies that can be set by WooCommerce:

Name: woocommerce_items_in_cart
Value: 1
Purpose: The cookie helps WooCommerce to determine when the content in the shopping cart changes.
Expiry date: after the end of the session

Name: woocommerce_cart_hash
Value: 447c84f810834056ab37cfe5ed27f204311246121-7
Purpose: This cookie is also used to recognize and save the changes in your shopping cart.
Expiry date: after the end of the session

Name: wp_woocommerce_session_d9e29d251cf8a108a6482d9fe2ef34b6
Value: 1146%7C%7C1589034207%7C%7C95f8053ce0cea135bbce671043e740311246121-4aa
Purpose: This cookie contains a unique identifier for you so that the shopping cart data can also be found in the database.
Expiration date: after 2 days

How long and where is the data stored?

Unless there is a legal obligation to store data for a longer period of time, WooCommerce deletes the data when it is no longer required for the purposes for which it was stored. For example, server log files that contain technical data about your browser and your IP address are deleted after 30 days. Until then, Automattic uses the data to analyze the traffic on its own websites (for example, all WordPress pages) and to fix possible problems. The data is stored on Automattic’s American servers.

How can I delete my data or prevent data storage?

You have the right to access your personal data at any time and to object to its use and processing. You can also lodge a complaint with a state supervisory authority at any time.

In your browser, you also have the option of individually managing, deleting or deactivating cookies. Please note, however, that deactivated or deleted cookies may have a negative impact on the functions of our WooCommerce online store. Depending on which browser you use, the management of cookies works slightly differently. Below you will find links to the instructions for the most common browsers:

Chrome: Delete, activate and manage cookies in Chrome

Safari: Managing cookies and website data with Safari

Firefox: Delete cookies to remove data that websites have stored on your computer

Internet Explorer: Deleting and managing cookies

Microsoft Edge: Deleting and managing cookies

Automattic is an active participant in the EU-U.S. Privacy Shield Framework, which regulates the correct and secure transfer of personal data. You can find more information about this at https://www.privacyshield.gov/participant?id=a2zt0000000CbqcAAC.
You can find more details about the privacy policy and what data is collected by WooCommerce and how at https://automattic.com/privacy/ and general information about WooCommerce at https://woocommerce.com/.

11. Use of the meta pixel (Facebook pixel) and Google Tag Manager

We place advertisements on Facebook and Instagram. In this context, we have integrated the “meta pixel” on our website.

The meta pixel makes it possible:

  • Measure the success of Facebook advertising campaigns.
  • to target visitors to our website again with advertisements on Facebook and Instagram.
  • To personalize the advertisements to the previously accessed pages or products.

The meta pixel is provided to us by Meta Platforms Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland).

During your visit to the website, the following data, among others, is transmitted to Meta:

  • Pages or URLs accessed
  • Orders including turnover and products ordered
  • The achievement of “website goals” (e.g. contact requests and newsletter registrations)
  • Your Internet connection data (IP address)
  • Technical information such as browser, end device and screen resolution
  • A randomly generated user ID
  • A randomly generated advertising click ID if you have reached our website via an advertisement

No personal data such as name, address or contact details are transferred to Facebook.

This data is potentially also transferred to Meta servers in the USA.

Meta stores cookies in your web browser for a period of one year since your last visit. These cookies contain a randomly generated user ID with which you can be recognized on future website visits. If you are logged in to Meta platforms such as Facebook/Instagram, Meta can also assign the visit to your Facebook/Instagram account.

We continue to use the Google Tag Manager service from Google. “Google” is a group of companies consisting of Google Ireland Ltd (provider of the service), Gordon House, Barrow Street, Dublin 4, Ireland and Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA and other affiliated companies of Google LLC.
We have concluded a data processing agreement with Google. Google Tag Manager is an auxiliary service and processes personal data itself only for technically necessary purposes. Google Tag Manager ensures that other components are loaded, which in turn may collect data. Google Tag Manager does not access this data.
Further information on Google Tag Manager can be found in Google’s privacy policy.
Please note that American authorities, such as intelligence agencies, could possibly gain access to personal data that is inevitably exchanged with Google via the Internet Protocol (TCP) when integrating this service due to American laws such as the Cloud Act.

If you do not agree with the collection, you can prevent this by installing a tracking blocker add-on in your browser or by rejecting the cookies via our cookie settings dialog.

12. Data protection provisions about the application and use of Shariff

The controller has integrated the Shariff component on this website. The Shariff component provides social media buttons that are compliant with data protection regulations. Shariff was developed for the German computer magazine c’t and is published via GitHub, Inc.

The developer of the component is GitHub, Inc. 88 Colin P. Kelly Junior Street, San Francisco, CA 94107, USA.

Usually, the button solutions provided by the social networks already transfer personal data to the respective social network when a user visits a website in which a social media button has been integrated. By using the Shariff component, personal data is only transmitted to social networks when the visitor to a website actively clicks on one of the social media buttons. Further information on the Shariff component is provided by the computer magazine c’t at http://www.heise.de/newsticker/meldung/Datenschutz-und-Social-Media-Der-c-t-Shariff-ist-im-Einsatz-2470103.html. The purpose of using the Shariff component is to protect the personal data of visitors to our website and at the same time to enable us to integrate a button solution for social networks on this website.

Further information and the applicable data protection provisions of GitHub can be found at https://help.github.com/articles/github-privacy-policy/.

13. Payment method: Data protection regulations for PayPal as a payment method

The data controller has integrated PayPal components on this website. PayPal is an online payment service provider. Payments are processed via so-called PayPal accounts, which are virtual private or business accounts. PayPal also offers the option of processing virtual payments via credit cards if a user does not have a PayPal account. A PayPal account is managed via an e-mail address, which is why there is no classic account number. PayPal makes it possible to initiate online payments to third parties or to receive payments. PayPal also assumes trustee functions and offers buyer protection services.

The European operating company of PayPal is PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal L-2449, Luxembourg.

If the data subject selects “PayPal” as the payment option during the ordering process in our online store, the data of the data subject is automatically transmitted to PayPal. By selecting this payment option, the data subject consents to the transfer of personal data required for payment processing.

The personal data transmitted to PayPal is usually first name, last name, address, email address, IP address, telephone number, cell phone number or other data required for payment processing. Personal data that is necessary for processing the purchase contract is also data that is related to the respective order.

The purpose of transmitting the data is to process payments and prevent fraud. The controller will transmit personal data to PayPal in particular if there is a legitimate interest in the transmission. The personal data exchanged between PayPal and the controller may be transmitted by PayPal to credit reference agencies. The purpose of this transmission is to check identity and creditworthiness.

PayPal may pass on the personal data to affiliated companies and service providers or subcontractors if this is necessary to fulfill the contractual obligations or if the data is to be processed on behalf of PayPal.

The data subject has the option of withdrawing consent to the handling of personal data from PayPal at any time. A revocation does not affect personal data that must be processed, used or transmitted for (contractual) payment processing.

The applicable data protection provisions of PayPal may be retrieved under https://www.paypal.com/de/webapps/mpp/ua/privacy-full.

14 Wordfence Security – Firewall & Malware Scan

Wordfence Security is used in the interest of securing our online services against brute force and DDoS attacks or comment spam. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. We endeavor to collect as little data as possible about usage. For security reasons, however, we are nevertheless forced to store the IP address of your end device and/or the network used. This data will be deleted after a maximum of six months and will not be passed on to third parties under any circumstances, except in the case of a corresponding legal obligation to the authorities.

You can find more information about Wordfence and GDPR – General Data Protection Regulation here: https://www.wordfence.com/help/general-data-protection-regulation/

15. Legal basis of the processing

Art. 6 I lit. a GDPR serves our company as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, when processing operations are necessary for the supply of goods or to provide any other service or consideration, the processing is based on Art. 6 I lit. b GDPR. The same applies to such processing operations that are necessary to carry out pre-contractual measures, for example in cases of inquiries about our products or services. If our company is subject to a legal obligation which requires the processing of personal data, such as for the fulfillment of tax obligations, the processing is based on Art. 6 I lit. c GDPR. In rare cases, the processing of personal data may become necessary in order to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured in our company and their name, age, health insurance details or other vital information would have to be passed on to a doctor, hospital or other third party. The processing would then be based on Art. 6 I lit. d GDPR. Ultimately, processing operations could be based on Art. 6 I lit. f GDPR. Processing operations that are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary to safeguard a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the data subject do not prevail. We are permitted to carry out such processing operations in particular because they have been specifically mentioned by the European legislator. In this respect, it took the view that a legitimate interest could be assumed if the data subject is a customer of the controller (Recital 47 Sentence 2 GDPR).

16. Legitimate interests in the processing pursued by the controller or a third party

Where the processing of personal data is based on Article 6 I lit. f GDPR, our legitimate interest is the performance of our business activities for the benefit of the well-being of all our employees and our shareholders.

17. Duration for which the personal data is stored

The criterion for the duration of the storage of personal data is the respective statutory retention period. After this period has expired, the corresponding data is routinely deleted, provided that it is no longer required for contract fulfillment or contract initiation.

18. Legal or contractual provisions for the provision of personal data; necessity for the conclusion of the contract; obligation of the data subject to provide the personal data; possible consequences of non-provision

We would like to inform you that the provision of personal data is partly required by law (e.g. tax regulations) or may also result from contractual regulations (e.g. information on the contractual partner). Sometimes it may be necessary for a contract to be concluded for a data subject to provide us with personal data that must subsequently be processed by us. For example, the data subject is obliged to provide us with personal data if our company concludes a contract with them. Failure to provide the personal data would mean that the contract with the data subject could not be concluded. Before personal data is provided by the data subject, the data subject must contact one of our employees. Our employee will inform the data subject on a case-by-case basis whether the provision of the personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data and what the consequences would be if the personal data were not provided.

19. Existence of automated decision-making

As a responsible company, we do not use automated decision-making or profiling.
